1) Scope and relationship to other provisions

These provisions apply to all Wallstoneberg services that require an account or enable the submission, uploading, linking or other provision of content (“UGC”). They supplement our Terms of Use, the Privacy Policy as well as any service-specific terms.

2) B2B-first registration

Wallstoneberg is a video-based business directory. During onboarding we collect business data only (company name, business address/location, website, business e-mail/telephone, opening hours, business description, at least one business video). Private home addresses, private telephone numbers or other non-business-related personal data are neither required nor desired.

3) Ownership of your content (UGC)

Your rights remain with you. You (or your licensors) retain all rights to the submitted content (e.g. descriptions, images, logos, videos, links).

3.1 Licence to Wallstoneberg

By submitting content you grant Wallstoneberg, for the duration of publication, a non-exclusive, worldwide, royalty-free licence to host, store, index, technically process (transcoding/thumbnails), make publicly available and display your content within our website.

Social announcements: To announce new listings, we may share the link to your Wallstoneberg page (with preview text/thumbnail) on our official LinkedIn and Facebook accounts. There is no re-upload of your files to third-party platforms.

3.2 Moral rights & attribution

You agree to the necessary technical adjustments (format/size/quality) and to the use of your company name/sign for assigning the listing; inalienable moral rights remain unaffected.

3.3 Representations & indemnity

You represent that you hold all required rights (copyright and related rights, trade marks, image/personality rights/model releases, music rights and any third-party licences) and that your content does not violate the law or the rights of third parties. You indemnify Wallstoneberg against claims by third parties arising from your UGC.

3.4 Removal & end of the licence

You may delete listings. The licence ends prospectively upon deletion; technical backups as well as already generated link previews/social posts may continue to exist for a reasonable period of time.

4) Publication standards (prohibited conduct)

Prohibited are content that is illegal, offensive, discriminatory, defamatory, obscene or otherwise unlawful; that promotes sexual exploitation/child pornography, human trafficking or criminal offences; that harasses, deceives or manipulates others (e.g. fake/paid reviews without disclosure, doxxing, coordinated abuse); that makes criminal/regulatory accusations without verifiable facts; that distributes spam/mass messages without relevance; that publishes/requests third-party personal data without a legal basis; that misleads about affiliations; that infringes third-party rights (copyright, trade marks, database rights, trade secrets) or circumvents technical protection measures.

We may decline to publish, downgrade, de-list or remove content that violates these standards or applicable law.

5) Moderation & notice / action (EU Digital Services Act)

Notice & action: Report allegedly illegal content via the legal contact point in the Imprint. Please include (a) URL(s), (b) a description and legal basis of the alleged infringement, (c) your contact details and (d) a good-faith statement of truth to the best of your knowledge. We will review the matter promptly and take appropriate measures (e.g. de-listing/blocking, request for clarification). Where measures are taken against content, the affected party receives a statement of reasons and may challenge the decision within the time limit via our internal complaint-handling system.

Optional US route (DMCA): Rights holders may additionally submit a DMCA notice (identification of the work, location/URL, contact details, good-faith statement, statement of accuracy/authority, signature). This does not replace the EU procedure.

6) Database rights, anti-scraping & TDM reservation

Database protection: The structure and content of the Wallstoneberg directory enjoy sui generis database protection and may also be protected by copyright. Substantial extractions or re-utilisation as well as any repeated/systematic extraction of insubstantial parts are prohibited without prior consent.

Automated access & hotlinking: Automated scraping/crawling, mass data export or re-publication (in whole or in substantial parts) without permission are prohibited. Normal hyperlinks to public profile pages are permitted. Hotlinking of our media files (direct embedding of image/video assets) and circumvention of access protection are not permitted.

Text and data mining (TDM) reservation: To the extent permitted by law, we object to TDM of our website/database, except in cases expressly permitted by law. The TDM reservation is declared in machine-readable form (e.g. via robots.txt/meta); licensed access may be offered on request.

7) Embedding & link previews

Embedding of links and of standard Open Graph/Twitter Card previews to Wallstoneberg pages is permitted. Embedding of our files (hotlinking) or misleading framing that conceals the origin is not permitted.

8) No partners · No sale or sharing

We maintain no third-party “partnerships” for data sharing and we do not sell or share your business data. We display your listing publicly on Wallstoneberg and post announcements exclusively as a link on our official LinkedIn/Facebook accounts. Service providers engaged by us act solely as processors within the meaning of Art. 28 GDPR (e.g. hosting/e-mail) – not as recipients for their own purposes.

9) Retention, fraud prevention & costs

We may retain content, logs and account data to the extent reasonably necessary to comply with legal obligations or legitimate requests, to enforce terms and conditions, to detect/prevent abuse or to protect users’ rights. Abusive or manifestly unfounded notices may be subject to appropriate costs (including legal costs).

10) Changes

We may adapt this policy to changed legal or technical conditions. Material changes will be highlighted on site. The current version will be published on wallstoneberg.com.
